General Terms and Conditions of Business
1. Basic information
These General Terms and Conditions (GTC) govern the legal relationship between the guest/customer/organiser, hereinafter referred to as the guest, and the Boutique Hotel Albergo Brione, hereinafter referred to as the hotel.
2. Jurisdiction / Applicable Law
The place of jurisdiction for any disputes arising from this contract is Minusio / Locarno (Switzerland). The place of performance and payment is the registered office of the Hotel. The GTC are written in German, English and Italian. In the event of contradictions, the German version shall prevail.
3. Definitions
Written Confirmations / Confirmation of Reservation: Fax and e-mail messages are also deemed to be written confirmations.
4. Subject matter of the contract / scope of application
The contract for the rental of rooms, areas as well as the purchase of other supplies and services comes into effect with the written confirmation of the guest. A reservation made on the day of arrival itself is binding at the moment of acceptance by the hotel. Changes to the contract shall only become binding for the hotel upon (written) reconfirmation.
5. Period of use
Subject to other agreements, the guest shall be entitled to use the rented rooms from 3:00 p.m. on the agreed day of arrival and until 11:30 a.m. on the day of departure.
6. Options
Option dates are binding for both parties – subject to other contractual agreements. The hotel may dispose of the opted rooms/rooms or services after unused expiry of the option period without further notice. The confirmation must be received by the hotel by 6:00 p.m. on the last day of the option period at the latest.
7. Prices / Obligation to pay
The prices communicated by the hotel are per night and in Swiss francs (CHF) including VAT and service. The visitor’s tax is charged separately and is based on the regulations on visitor’s taxes of the municipality of Minusio. The guest is obliged to pay the agreed or applicable prices of the hotel for the provision of the room and the other services used by him. This also applies to orders placed by his companions and visitors. The valid prices are those confirmed by the hotel (in CHF). The prices may be changed by the hotel if the guest subsequently initiates changes in the number of rooms booked, the services provided by the hotel or the length of stay of the guests. In the event of an obvious incorrect booking due to system-related errors in the booking system, the agreed prices shall be null and void. In this case, the hotel has the right to cancel the booking without compensation. The hotel may request a credit card guarantee at any time. The hotel shall be entitled to invoice or interim invoice its services to the guest at any time. The final invoice shall include the agreed price plus any additional amounts which have arisen due to additional services provided by the hotel for the guest and/or the persons accompanying him. Unless otherwise agreed, the final invoice shall be paid in Swiss francs in cash or by accepted credit card at the latest at the time of check-out on the day of departure.
8. Cancellation of the Reservation / Fees / Cancellation
Cancellation of the reservation requires the written consent of the hotel. If this is not given, the agreed price must be paid even if the guest does not make use of contractual services. If the guest fails to appear (“no-show”), 100 % of the booked services for the first three days of the stay shall be charged. The date of receipt of the guest’s written cancellation by the hotel is decisive for the calculation of the cancellation fee. This applies to both letters and e-mail messages.
9. Early departure
If the guest departs early, the hotel is entitled to charge 100% of the total booked services.
10. Animals
Animals may only be brought into the hotel with the prior consent of the hotel and for a special fee.
11. The guest is responsible for his/her own personal insurance cover (in particular accident and health insurance, damage to property and luggage and loss of luggage). The hotel declines any liability.
